영주권신청자 대면인터뷰 확대 2017/10/1효력발생

2017년 10월 1일부터 모든 I-485신청자에 대한 대면인터뷰가 실시될 것이라는 신문기사가 뜨고 있습니다. 이민자들이 참으로 스트레스 받을 기사죠? 제가 좀 더 정확히 알고 싶어 이민국 발표 전문을 읽어보니, 인터뷰를 단계적으로(phase-in) 실시할 것이라고 합니다. 다들 아시겠지만 phase-in 의 사전적 의미를 자세히 봅시다.

(1) to start to use or do (something) gradually over a period of time

(2) to introduce (something) slowly

영주권자 대면인터뷰를 전면 실시한다는 점은 자명합니다. 과거 20%가량 진행했던 영주권인터뷰를 어느정도 기간에 걸쳐 100%를 향해 점진적으로 늘리겠다고 해석됩니다. 따라서 I-485 신청자들이 기다리는 기간이 좀 더 늘어날 수 있을 거라고 예상할 수 있겠습니다만, 실제로 얼마나 기다리게 될지 예측하기 어렵습니다. 안그래도 이민국 직원의 수가 부족한데 트럼프정권의 이런 정책으로 인해 영주권 결과를 기다리는 이민자의 삶이 더 힘들어지고 있습니다. 10월부터  I-485 접수자의 대면인터뷰 확대 실시가 어떻게 벌어질지 조금 더 지켜봐야 할 것 같습니다.

참고로 접수날짜가 2017년 10월 1일 이전인 신청자에 대해서도 인터뷰를 볼지 여부는 전혀 알려진 바 없습니다. 따라서 접수날짜 상관없이 10월 1일 이후 추세를 다시 살펴봐야 할 것입니다.

USCIS will begin expanding in-person interviews for certain immigration benefit applicants whose benefit, if granted, would allow them to permanently reside in the United States.

이민국은 특정 미국 영주권 신청자를 대상으로 대면인터뷰(in-person interviews)를 확대할 것이라고 합니다.

Under Executive Order 13780, it protects the Nation From Foreign Terrorist Entry Into the United States. It is part of the agency’s comprehensive strategy to further improve the detection and prevention of fraud and further enhance the integrity of the immigration system. 

기본적으로 행정명령 13780호를 준수하기 위한 변화입니다.

(1) 미국에 입국할 외국의 테러리스트 침입으로부터 미국을 보호하기 위한 목적

(2) 사기 탐지 및 방지를 더욱 개선하기 위한 목적

(3) 이민시스템의 보전을 더욱 향상시키기 위한 목적

영주권 신청자 대면인터뷰는 이민국의 포괄적 전략 중 일부입니다.

Effective Oct. 1, 2017, USCIS will begin to phase-in interviews for the following.

(1)과 (2)에 해당하는 신청자에 대해 단계적 인터뷰(phase-in interviews)를 시작할 것입니다. 

(1) Adjustment of status applications based on employment (Form I-485, Application to Register Permanent Residence or Adjust Status).

(2) Refugee/asylee relative petitions (Form I-730, Refugee/Asylee Relative Petition) for beneficiaries who are in the United States and are petitioning to join a principal asylee/refugee applicant.

Previously, applicants in these categories did not require an in-person interview with USCIS officers in order for their application for permanent residency to be adjudicated. Beyond these categories, USCIS is planning an incremental expansion of interviews to other benefit types. 

과거, 위의 카테고리에 해당하는 신청자에 대해 영주권을 판단하기 위한 이민 심사관의 대면인터뷰를 요구하지 않았습니다. 이민국은 이 카테고리를 너머 다른 수혜타입에 대한 인터뷰도 상당히 확대할 계획입니다.

“This change reflects the Administration’s commitment to upholding and strengthening the integrity of our nation’s immigration system,” said Acting USCIS Director. “USCIS and our federal partners are working collaboratively to develop more robust screening and vetting procedures for individuals seeking immigration benefits to reside in the United States.”

이민국장에 따르면, 이러한 변화는 미국의 이민시스템의 보전을 유지하고 강화하려는 행정부의 전념을 반영한 것이라고 합니다. 이민국 및 연방 파트너들은 미국에 거주하기 위한 이민 혜택을 찾는 사람들을 위해 좀 더 강력한 심사와 검열을 발전시키기 위해 협력하여 일할 것이라고 합니다.

Conducting in-person interviews will provide USCIS officers with the opportunity (1) to verify the information provided in an individual’s application, (2) to discover new information that may be relevant to the adjudication process, and (3) to determine the credibility of the individual seeking permanent residence in the United States.  USCIS will meet the additional interview requirement through enhancements in training and technology as well as transitions in some aspects of case management.

대면인터뷰를 실시하는 것은 (1) 이민국 심사관들에게 개인의 신청서에 제공된 정보를 확인할 기회를 제공합니다. (2) 판단 과정과 관련이 있을 수 있는 새로운 정보를 찾을 수도 있습니다. (3) 또한 미국영주권을 받으려는 개인이 믿을만한지 판단 할 수 있습니다. 이민국은 케이스 관리의 측면에서 과도기일 뿐만 아니라 훈련과 기술의 향상을 통하여 추가 인터뷰 요구조건을 만족할 것입니다.
